In a narrow decision, the Supreme Court ruled that Quebec’s health-care regulations constituted an infringement of individual rights under the Quebec Charter, and that this infringement could not be justified on the grounds of any legitimate state purpose. “Access to a waiting list is not access to health care,” the Court proclaimed, going on to say that as long as the government was unable to provide effective health services, it had no business preventing its citizens from procuring these services through private means.
